Cubalex denounces the arbitrary detention of Asdr\u00fabal Kindel\u00e1n Garbey, who has been held for two months in the Mar Verde prison, in the province of Santiago de Cuba, accused of an alleged crime of \u201ccontempt\u201d.<\/p>\n\n\n\n
On March 23, Asdr\u00fabal was violently arrested in the street while broadcasting live to denounce the arbitrary and illegal detention of his son, Cristian Osmauris Kindel\u00e1n Mora, who had participated in a peaceful demonstration on March 17 in Santiago de Cuba.<\/p>\n\n\n\n
Initially, Asdr\u00fabal was released on bail of 50,000 pesos. However, on March 25, he was summoned again, and his mother, Teresa Garbey, was informed that the bail would be returned and that he would be detained for an alleged crime of \u201ccontempt.\u201d.<\/p>\n\n\n\n
Asdr\u00fabal allegedly told instructor \u201cYoana\u201d that Major Oscar \u201cwas going to make him pay.\u201d However, the instructor herself informed Asdr\u00fabal\u2019s mother and other relatives that Major Oscar and the unit chief, \u201cAbel,\u201d demanded she make this statement. Teresa Garbey reported this situation to the prosecutor\u2019s office, but the agency has not taken any action.<\/p>\n\n\n\n
Furthermore, on April 5, a request for absolute nullity of the actions of the authorities was filed, for violating the rights and guarantees of due process, which to date has not been answered.<\/p>\n\n\n\n
The conduct of the officials involved implies several crimes, including abuse of authority, for exercising the functions inherent to their position in a manner contrary to the laws and arbitrarily exceeding the legal limits of their competence.<\/p>\n\n\n\n
It also constitutes the crime of prevarication, by maliciously promoting the criminal prosecution of a person whose innocence they know to be true, as well as the crime of torture and other cruel, inhuman or degrading treatment or punishment.<\/p>\n\n\n\n
In this case, we denounce the deliberate intention of the authorities to inflict suffering on Asdr\u00fabal to punish him for denouncing the persecution of his son for exercising his right to peaceful protest.<\/p>","protected":false},"excerpt":{"rendered":"
