Despite his health condition, authorities are keeping him in a cell with other HIV-positive inmates as a method of intimidation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Furthermore, he is denied access to a bed, forcing him to remain on the floor, which constitutes cruel and inhuman treatment that violates his fundamental rights. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Arbitrary detention and violations of due process<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Nando OBDC was arbitrarily detained on December 31, 2024, without due process. He currently faces fabricated charges of \u201cterrorism,\u201d a systematic practice of the Cuban state to criminalize artists, activists, and dissenting voices. <\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<div class=\"embed-x\"><blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\"><p lang=\"es\" dir=\"ltr\">\ud83d\udea8 <a href=\"https:\/\/x.com\/hashtag\/AlertaCubalex?src=hash&amp;ref_src=twsrc%5Etfw\">#AlertaCubalex<\/a> The visual artist, rapper and activist Fernando Almenares Rivera, known as Nando Obdc, has been arbitrarily detained and held incommunicado since December 31, under investigation. <a href=\"https:\/\/t.co\/OebqV0EQUj\">pic.twitter.com\/OebqV0EQUj<\/a><\/p>\u2014 Cubalex (@CubalexDDHH) <a href=\"https:\/\/x.com\/CubalexDDHH\/status\/1875229916675133883?ref_src=twsrc%5Etfw\">January 3, 2025<\/a><\/blockquote><script async src=\"https:\/\/platform.x.com\/widgets.js\" charset=\"utf-8\"><\/script><\/div>\n<\/div><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">The arrest occurred on the morning of December 31, when State Security agents stormed into his home without presenting a summons or court order, violating his fundamental rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On January 2, State Security conducted a disproportionate raid on his home, deploying approximately six vehicles, including forensic units. During the operation, agents thoroughly searched the residence for hidden information, electronic devices, or flash drives, but found no evidence against him.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, they took numerous photographs of the paintings the artist had made on the walls of his home and confiscated a Cuban flag.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This case demonstrates the use of state repression to silence art and dissent in Cuba, violating the rights to freedom of expression, personal integrity, and due process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The conditions in which he is being held violate international standards on the dignified treatment of persons deprived of their liberty, including the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">From Cubalex, we demand his immediate release and call on the international community and human rights organizations to bring his case to light and denounce these serious violations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>","protected":false},"excerpt":{"rendered":"<p>El artista y activista Fernando Almenares Rivera, conocido como Nando OBDC,&nbsp; permanece encarcelado en condiciones inhumanas en la prisi\u00f3n de m\u00e1xima seguridad Combinado del Este, en La Habana.
