The campaign Childhood and Land: Rights at Risk<\/em><\/strong> Cubalex focuses on two areas that should be a source of protection and development for citizens, but which in Cuba are permeated by state control and a lack of real guarantees.<\/p>\n\n\n\n

Based on a legal analysis, our team identified key findings that show how the new regulations strengthen political control and restrict fundamental rights.<\/p>\n\n\n\n

Childhood: a Code without real guarantees<\/strong><\/h2>\n\n\n\n

He Children, Adolescents and Youth Code<\/strong> The agreement approved in Cuba presents profound contradictions with international human rights standards. Among the main findings are:<\/p>\n\n\n\n

  • Imposed ideological duties<\/strong> \u2192 The Code obliges girls and adolescents to honor the homeland and defend socialist values, which in practice means indoctrination and exclusion of those who think differently.
    <\/li>\n\n\n\n
  • Police control over adolescence<\/strong> \u2192 The MININT can intervene in cases of adolescents without a judge or trial, criminalizing natural stages of adolescence.
    <\/li>\n\n\n\n
  • Lack of protection against violence<\/strong> \u2192 There are no clear mechanisms to report sexual abuse, family or institutional violence.
    <\/li>\n\n\n\n
  • Structural discrimination ignored<\/strong> \u2192 Afro-descendant girls, girls with disabilities, or daughters of dissidents are rendered invisible.
    <\/li>\n\n\n\n
  • Deprivation of liberty without crime<\/strong> \u2192 Internment is permitted for \u201csocial dangerousness\u201d or \u201cbehavioral disorders\u201d, contravening international standards.
    <\/li>\n\n\n\n
  • Rights subject to ideological loyalty<\/strong> \u2192 Education is conceived as a way to train \u201ccontinuers of the revolutionary work\u201d.
    <\/li>\n\n\n\n
  • Without redress or legal recourse<\/strong> \u2192 The Code does not offer effective procedures for challenging arbitrary decisions or mechanisms for redress.
    <\/li>\n<\/ul>\n\n\n\n

    Land: a resource under threat<\/strong><\/h2>\n\n\n\n

    The new Draft Land Law<\/strong> It also concentrates power in the state, weakening basic rights of peasant farmers. The findings identified include:<\/p>\n\n\n\n

    • Reinforced state monopoly<\/strong> \u2192 The land remains the property of the State, even though it is worked by families for generations.
      <\/li>\n\n\n\n
    • Severe restrictions on private property<\/strong> \u2192 It is prohibited to lease, mortgage or freely transfer the land, emptying the property of real content.
      <\/li>\n\n\n\n
    • Administrative discretion<\/strong> \u2192 The Ministry of Agriculture can declare land as idle or poorly exploited without objective criteria, generating insecurity.
      <\/li>\n\n\n\n
    • Arbitrary termination of usufruct<\/strong> \u2192 Ambiguous causes such as \u201cabandonment\u201d or \u201cinappropriate use\u201d allow peasants to be dispossessed of their land, even in situations of force majeure.
      <\/li>\n\n\n\n
    • Lack of effective judicial protection<\/strong> \u2192 Conflicts are resolved by administrative commissions dependent on the State itself.
      <\/li>\n\n\n\n
    • Structural inequality<\/strong> \u2192 There are no measures in place to protect rural women, Afro-descendants, the elderly, or people with disabilities, perpetuating historical exclusions.\u00a0<\/li>\n<\/ul>\n\n\n\n

      Why make these findings visible?<\/strong><\/h2>\n\n\n\n

      Childhood and land are not isolated issues: both reveal how the Cuban state subordinates fundamental rights to political and ideological ends. By imposing mandatory loyalty, denying protection to the most vulnerable, and controlling vital resources, patterns of repression and exclusion are consolidated, affecting entire communities.<\/p>\n\n\n\n
