Throughout 2026, a total of 95 people appear in at least one incident related to punishment cells or isolation. However, it does allow us to identify cases that require closer scrutiny, verify possible patterns of punishment, and document the conditions faced by people deprived of their liberty.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Prolonged isolation: a practice incompatible with international standards<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The United Nations Standard Minimum Rules for the Treatment of Prisoners, known as<a href=\"https:\/\/www.unodc.org\/documents\/justice-and-prison-reform\/Nelson_Mandela_Rules-S-ebook.pdf\"> Mandela Rules<\/a>, They establish precise limits on the use of prison isolation. The 66 days he spent alone in a cell, according to his testimony to his wife, far exceed the time threshold established by the Nelson Mandela Rules for considering isolation prolonged, provided it is confirmed that the conditions of separation meet the definition of Rule 44. Placement in an infirmary does not eliminate the need to assess the actual conditions of confinement, nor does it automatically transform isolation into a therapeutic measure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the case of a 73-year-old with diabetes and other health conditions, the authorities must carefully consider the risks that prolonged separation may pose to their health. If the isolation is not based on a genuine medical need, if there is no adequate health supervision, or if it is used as punishment, the situation raises further concerns about the legality, necessity, and proportionality of the measure.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Lack of medical attention exacerbates the risks of isolation<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Isolation and medical neglect are distinct problems, but their effects can accumulate. Incarcerated individuals retain their right to health, and the State has the obligation to guarantee them care that is essentially equivalent to that available in the community, without discrimination based on their political opinions or the nature of the charges against them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When a sick person is kept in isolation for a prolonged period and does not receive the necessary healthcare, the combination of both factors may constitute cruel, inhuman, or degrading treatment, depending on the specific circumstances, the severity of the omissions, their effects, and the responsibility of the authorities. The legal classification requires a comprehensive assessment, but the reported situation warrants urgent intervention to prevent irreparable harm.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cuba is a State Party to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, which it ratified on May 17, 1995, and which entered into force for the country on June 16 of that year, according to the records of the Office of the United Nations High Commissioner for Human Rights. The Convention obliges the State to prevent torture and other ill-treatment and to adopt effective measures to prevent them in places under its jurisdiction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Applying these obligations to Navarro&#039;s case requires examining the conditions of his isolation, its purpose, the medical care he received, the decisions of the prison authorities, and the known risks to his health. The duration of his isolation, his age, and his medical conditions are relevant factors in this assessment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cubalex&#039;s records of isolation and lack of medical care also justify examining whether the authorities have effective mechanisms in place to monitor prison conditions, investigate complaints, correct abusive practices, and sanction those responsible when appropriate.
