No. The Cuban Constitution establishes the mandatory nature of providing legal counsel from the beginning of criminal proceedings. Therefore, if a person does not hire a lawyer and requests one from the prosecuting authority, that authority cannot deny them.<\/p>\n\n\n\n
Furthermore, according to the Criminal Procedure Law, there are investigative procedures that the authorities cannot carry out if the accused is without legal representation, such as taking the initial statement. If the person agrees to give a statement\u2014which is a voluntary act on the part of the accused, who can always exercise their right to remain silent\u2014Article 12.2 of the law stipulates that if the person is being held in pretrial detention or imprisoned for another reason and does not appoint legal counsel within 48 hours of being formally charged, the acting authority is obligated to appoint one ex officio.<\/p>\n\n\n\n
The authorities must inform you of your right to choose a lawyer. This is a guarantee of due process and legal certainty.<\/p>\n\n\n\n
International standards also regulate the right to a court-appointed lawyer if the person lacks the means to hire one.<\/p>\n\n\n\n
