{"id":9932,"date":"2023-08-02T22:13:00","date_gmt":"2023-08-03T02:13:00","guid":{"rendered":"https:\/\/cubalex.org\/?p=9932"},"modified":"2026-08-22T10:12:45","modified_gmt":"2026-08-22T14:12:45","slug":"proteccion-penal-del-orden-constitucional-en-cuba","status":"publish","type":"report","link":"https:\/\/cubalex.org\/en\/informe\/proteccion-penal-del-orden-constitucional-en-cuba\/","title":{"rendered":"Criminal protection of the constitutional order in Cuba"},"content":{"rendered":"<p class=\"wp-block-paragraph\"><strong><em>Se trata de la confirmaci\u00f3n de que hemos transitado de una dictadura a otra desde el golpe de Estado de Fulgencio Batista hasta nuestros d\u00edas y que el derecho penal y los tribunales de justicia son una herramienta de control de la ciudadan\u00eda.<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El presente informe aborda un repaso breve por la historia constitucional para analizar los mecanismos legales utilizados para proteger el orden constitucional y su intangibilidad, as\u00ed como su relaci\u00f3n con las protestas del 11 de julio de 2021, mediante uso de la ley penal como herramienta de represi\u00f3n.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Se trata de la confirmaci\u00f3n de que hemos transitado de una dictadura a otra desde el golpe de Estado de Fulgencio Batista hasta nuestros d\u00edas y que el derecho penal y los tribunales de justicia son una herramienta de control de la ciudadan\u00eda. Hoy est\u00e1n vigentes la pena de confiscaci\u00f3n y de muerte por causas pol\u00edticas. No se han restaurado las garant\u00edas b\u00e1sicas del debido proceso y se discrimina a toda persona que incumpla o est\u00e9 en desacuerdo con las decisiones pol\u00edticas o econ\u00f3micas del grupo en el poder. La investigaci\u00f3n continuar\u00e1 con el an\u00e1lisis individualizado de los casos de personas sancionadas por motivos de opini\u00f3n pol\u00edtica.
