Inhuman Treatment: Violations of the Rights of Political Prisoners in Cuba

General Comment No. 21 on the Humane Treatment of Persons Deprived of Liberty, issued under the International Covenant on Civil and Political Rights, establishes a framework for ensuring respect for, dignity of, and protection of all persons in detention. However, in some contexts, reality falls far short of the provisions of this international instrument. This is the case of some political prisoners in Cuba, whose conditions of detention raise serious concerns about respect for and application of the principles enshrined in the Covenant.

Based on the General Comment No. 21 on the Humane Treatment of Persons Deprived of Liberty of the International Covenant on Civil and Political Rights, The reported cases of political prisoners Daniel Moreno de la Peña and José Daniel Ferrer García raise several concerns regarding compliance with the principles and norms stipulated in the pact. Some of the most relevant points are detailed below:

1. Dignity and respect for the person: Article 10 of covenant It states that all persons deprived of their liberty must be treated humanely and with respect for the inherent dignity of the human being. In the reported cases, the health conditions and circumstances in which the detainees find themselves (injuries, lack of medical attention, weight loss, unsanitary conditions) are indicative of a lack of respect for their dignity and humanity.

2. Protection against torture and cruel treatment: The covenant prohibits torture and other cruel, inhuman, or degrading treatment or punishment. Reports concerning the health of these political prisoners, along with the lack of adequate medical care and the unsanitary conditions of their detention, may be considered cruel and inhuman treatment.

3. Basic rights and conditions of detention: The reported conditions, including the presence of insects, bites, and lack of medical care, indicate a clear violation of the minimum standards of treatment for detainees, as set out in the Standard Minimum Rules for the Treatment of Prisoners and other relevant United Nations instruments mentioned in the General Comment.

4. Access to medical care: The denial of medical care and the control of essential medicines are contrary to the principles of the pact. The health and well-being of detainees must be a priority, and the State has the responsibility to ensure that these rights are respected.

5. Isolation conditions: The report on José Daniel Ferrer García mentions that he is being kept in an isolation cell, which can be considered inhumane treatment, especially if it is not justified or is unnecessarily prolonged.

Based on the information provided, it can be concluded that the aforementioned political prisoners are not receiving humane and adequate treatment in accordance with the international standards established in General Comment No. 21 of the Human Rights Committee. These conditions of detention constitute a serious violation of human rights and require urgent intervention to guarantee the protection and well-being of the detainees.

The dignity, respect, and well-being of detainees are not mere aspirations, but fundamental rights recognized internationally. General Comment No. 21 reflects the essence of these rights and serves as a benchmark for assessing the conditions of detainees in different contexts. 

Unfortunately, the cases of Daniel Moreno de la Peña and José Daniel Ferrer García highlight a stark disconnect between international standards and the reality faced by some political prisoners in Cuba. The reported violations are extremely serious and require an immediate and decisive response. It is imperative that effective measures be taken to remedy these situations, guaranteeing respect for and protection of the human rights of all detainees.
