Cubalex denounces the arbitrary detention of Asdrúbal Kindelán Garbey, who has been held for two months in the Mar Verde prison, in the province of Santiago de Cuba, accused of an alleged crime of “contempt”.
On March 23, Asdrúbal was violently arrested in the street while broadcasting live to denounce the arbitrary and illegal detention of his son, Cristian Osmauris Kindelán Mora, who had participated in a peaceful demonstration on March 17 in Santiago de Cuba.
Initially, Asdrúbal was released on bail of 50,000 pesos. However, on March 25, he was summoned again, and his mother, Teresa Garbey, was informed that the bail would be returned and that he would be detained for an alleged crime of “contempt.”.
Asdrúbal allegedly told instructor “Yoana” that Major Oscar “was going to make him pay.” However, the instructor herself informed Asdrúbal’s mother and other relatives that Major Oscar and the unit chief, “Abel,” demanded she make this statement. Teresa Garbey reported this situation to the prosecutor’s office, but the agency has not taken any action.
Furthermore, on April 5, a request for absolute nullity of the actions of the authorities was filed, for violating the rights and guarantees of due process, which to date has not been answered.
The conduct of the officials involved implies several crimes, including abuse of authority, for exercising the functions inherent to their position in a manner contrary to the laws and arbitrarily exceeding the legal limits of their competence.
It also constitutes the crime of prevarication, by maliciously promoting the criminal prosecution of a person whose innocence they know to be true, as well as the crime of torture and other cruel, inhuman or degrading treatment or punishment.
In this case, we denounce the deliberate intention of the authorities to inflict suffering on Asdrúbal to punish him for denouncing the persecution of his son for exercising his right to peaceful protest.
