The Municipal Prosecutor's Office of the capital city's Playa municipality verbally informed her that she would be evicted, without presenting written notification or offering minimum guarantees.
On September 18, Marcia went to the Prosecutor's Office to pick up the response to a complaint she had filed in April. The prosecutor refused to give her the document and instead verbally informed her that she had to vacate her home the following day. As justification, the prosecutor stated that Marcia had "accepted" the eviction by signing a document during an arbitrary detention. Marcia maintains that she did so under duress, pressured by the urgent need to leave and care for her 102-year-old bedridden mother.

Marcia faces serious health problems. She lives with a permanent colostomy and suffers from hypertension, which puts her in a constantly vulnerable state. Her medical condition requires ongoing care, specialized attention, and stability to prevent complications.

Background of the case
On September 8, 2025, Marcia was arrested arbitrarily after attending a summons at PNR Station 110. During that detention she was forced to sign an alleged abandonment of housing.
However, the property was legally assigned to her on December 8, 2020, through an occupancy certificate. In 2022, Resolution 559 of the Playa Municipal Housing Directorate recognized her legal occupancy. She also possesses a Certificate of Legal Occupant issued by Control Fondo. Based on these documents, Marcia rehabilitated the house with her own resources after receiving it in a state of disrepair.
She was never notified of a decision revoking that assignment, nor did she have the opportunity to participate in any administrative or judicial proceedings. This violates essential rights such as due process, equality of arms, and the right to a defense.
Risk of abandonment
